Judicial killing of a minor and inhuman torture by BSF people

We are giving you two cases of BSF (Border Security Force) torture. You will find how inhuman and desperate is this force. The officers of that force, the police administration, local mafias, leaders of political parties, elected members of Gram Panchayet (local self government) are hand in glove to protect the perpetrators. There is no protection of the victim family. Is it not a failure of the governance? Will you please take up those cases and send your protests to the concerned authorities so that the victims can get justice and impunity be stopped. With regards CASE NO. 1 Name of the victim: Kalidas Ghosh (Deceased) s/o Kartik Ghosh, Age 17 years, Village Angrail Dakshinpara, Post Office Angrail, Police Station Gaighata, District North 24 Parganas, West Bengal, India. Name of the Perpetrators: (1) Mr. Ram Dhan Rathore, constable of Border Security Force, Battalion Number 126 of 'E' Company, Border Out Post Number 6, near Angrail Dakshinpara village under Gaighata Police Station. (2) Inspector-in-Charge, Gaighata Police Station, District North 24 Parganas. Place of Incident: Inside the campus of Angrail Bidyamandir High School, Village - Angrail Dakshinpara, Police Station Gaighata, District North 24 Parganas, West Bengal. Date and Time of Incident: On 28.12.2007 at 5.30 p.m. Case Details: It is revealed through primary fact finding of MASUM that Mr. Ram Dhan Rathore, a constable in Battalion Number 126 of 'E' Company, Border Out Post Number 6 of Border Security Force shot dead a minor, Kalidas Ghosh who was student of Angrail Bidyamandir High School at Angrail Dakshinpara village under Gaighata Police Station on 28.12.2007 at 5.30 p.m.. The fact of the gruesome incident was that the victim, Kalidas Ghosh went to school at 3.30 p.m. on the fateful day to decorate playground of the school for Annual Sports of the said school with some other schoolmates. After completing his work, Kalidas was playing with his friends wearing his school uniform in play ground of the school. Suddenly the ball reached near the Out Post as described above. When those schoolboys went to find the ball some officers of Border Security Force chased them and those boys ran away from the school in fear. The victim boy was searching for the ball and proceeded further but ultimately he also retreated when he was chased by the perpetrator, BSF constable. The victim could understand the gravity of the situation and he fled away from the spot and took shelter in the school compound. In the school premises he thought it was safe. But, he was proved wrong. The perpetrator constable followed the boy and had misfired few occasions, the boy had got hair breath escape for few shots, but finally BSF constable got him into close range after he followed the boy and shot him dead by firing. The student was in school uniform. At 7 p.m. in the evening Mr. Shubhendu Ghosh, Sub Divisional Officer and Mr. Subhas Sen, Sub Divisional Police Officer of Bangaon, reached at the place of incident in the evening on 28.12.2007 and the body of the victim was sent to J. N. Dhar General Hospital, Bongaon, North 24 Parganas for conducting Post Mortem. On 29.12.2007 local people went on protest against the inhuman crime committed by BSF by killing a minor student. Tushar Kar, Inspector-in-Charge of Gaighata Police Station went the place of incident on 29.12.2007 in civil dress but he refused to interact with MASUM's fact finding team and behaved with him in humiliating manner while the fact finding team tried to guide the victim family properly. In the meantime, Mr. Krishnapada Ghosh, the maternal uncle of the victim boy lodged complaint with Gaighata Police Station on 28.12.2007 in the evening but the police did not give the complainant any copy of the complaint received nor the copy of the FIR as provided in 154 Cr.P.C. It is initially not known to the victim's family whether any case was started by police against the BSF personnel. Striking enough that the complaint was drawn at the instance and dictation of the Inspector-in-Charge of Gaighata Police Station. Ultimately it was found that upon the complaint of the Victim's family a police case Gaighata Police Station case no 454 under section 302 of Indian Penal Code dated 28.12.2007 for murder was started. In retaliation, BSF also lodged counter complaint against Kalidas Ghosh and the same was registered at the said police station being Gaighata Police Station case no 455 dated 28/12/07 under sections 186/353/307 Indian Penal Code for attempting to murder and assaulting the public servant etc. Investigating officer of the case was Mr. Tapas Chakraborty. It is shocking and surprising that how a minor boy who was unarmed could attempt to kill BSF or any public officer while BSF is armed to teeth? The complaint of BSF is counterblast of the complaint lodged by the victim's family and it is not on merit and the police was pleased to record the complaint readily. Local people went on protest blocking the road on 29.12.2007 against the ghastly murder by BSF and the police disbursed the protesting people by lathi-charge. On 29.12.2007 Sub Divisional Officer and Sub Divisional Police Officer went to the village along with Tushar Kar for investigation. The local people informed MASUM's fact finding team that Border Security Force is indulging into illegal acts frequently in the area. The eyewitnesses of the incident are tight lipped due to fear of BSF. On 30.12.2007, Mr Monoj Kumar, an official of BSF, Mr Subrata Sarkar, a member of Gram Panchayat, Dr. Dulal Sarker, owner of a local Nursing home, Mr. Samir Mazumdar, a local person, having good rapport with BSF and one official of BSF visited the house of the victim and persuaded the victim's family for compromise, it has been learnt from the sources, the family was offered money for mutual settlement. Already money has been transferred to the victim's family for compromising the matter. It is unlikely that justice would be brought under such pressure and allurement. CASE NO. 2 Name of the Victim: - Paresh Mondal (35), Schedule Caste, s/o Late Asari Mondal residing at village-Nalbona Colony, Post- Bamnabad, Police Station- Jalangi, District Murshidabad, West Bengal Name of the Perpetrators: - 1. Official from District Intelligence Bureau, Murshidabad, 2. The Sub Inspector of Kakmari Border Security Force Camp and four constables of Khayertala Border out post number 5, District- Murshidabad, West Bengal. Place of Incident: - Out post Number 5 of Khayertala Border out Post, District- Murshidabad, West Bengal. Date of Incident: - 23/10/07 at about 12.30 p.m . Case Details: - Masum got information that on 23/10/07 one fisherman named Mr. Paresh Chandra Mondal went for fishing at Padma River. After his work he was returning with his five colleagues. In the meantime, two smugglers were trying to smuggle buffalos with the help of some personnel of Border Security Forces (BSF) number 1 outpost. Suddenly one person from District Intelligence Bureau (DIB) appeared in the scene. The smugglers hid the buffaloes and fled from that place. The person from DIB found Paresh and his companions at that place and he instructed them to fix their boat at the bank of the river. Paresh and his colleagues complied. Suddenly the person from DIB slapped at Paresh's face. Paresh fell down. Then he beat Paresh at his waist with a baton. The other colleagues of Paresh also were beaten by the said DIB and some constables from out post number 5. They also snatched some costly fishes forcefully from their catch. After that they released Paresh and his colleagues. Paresh became ill after returning home due to the physical torture meted to him. He received swelling injury in his right side of the face and bluish mark in left buttock. The medical report suggests such injuries in his person. Our fact finding team took Paresh to a primary health centre. He got some first aid from that primary health centre and he was referred to Berhampore New General Hospital. But due to his poor economical condition he could not go to Berhampore New General Hospital. Our organization received several number of information about brutal physical torture by BSF off and on at the border area. We came to know that some smugglers are continuing their illegal trade with the help of some BSF personnel while some times some smugglers who could not build rapport with BSF personnel face reprisal from BSF. We got information that recently BSF personnel have started one of the most despicable practices that they are inserting their batons into the anus of the accused persons. We received several complaints against one sub inspector of Bamnabad BSF camp and against some DIB personnel.
